Terms and conditions for giveaways run by MYCOVER Protection GmbH
1. Organizer and Subject Matter
1.1.
MYCOVER Protection GmbH, Dahlenburger Landstraße 179A, 21337 Lüneburg, Germany (“Organizer”), organizes giveaways via social media platforms (each a “Giveaway”). A giveaway may be held simultaneously on multiple platforms; in this case, it is considered a single giveaway with a joint draw.
1.2.
The Organizer promotes and conducts its giveaways via its official social media channels, particularly Instagram and Facebook. The details provided in the respective giveaway post (“Giveaway Post”) are authoritative.
1.3.
The giveaway is conducted exclusively by the Organizer. It is not sponsored, endorsed, or organized by Meta Platforms Ireland Ltd. (Instagram, Facebook) or the respective platform operator and is in no way connected to them; the platform serves solely as a technical medium. All questions and complaints regarding the giveaway must be directed exclusively to the Organizer. The participant releases the platform operator from any claims in connection with the giveaway.
1.4.
By participating in the giveaway, the participant agrees to these terms and conditions.
1.5.
These terms and conditions apply to all giveaways organized by the Organizer. The specific details of the promotion, in particular the closing date, entry requirements, and prizes, are set out in the respective Giveaway Post. The version of these terms available at the time the Giveaway Post is published shall be authoritative.
1.6.
If a giveaway is conducted jointly with a cooperation partner, this will be indicated in the Giveaway Post. The Organizer remains the sole point of contact for the execution, determination of winners, and shipping, unless otherwise stated in the Giveaway Post.
2. Giveaway period
2.1.
The entry period begins with the publication of the Giveaway Post and ends at the time specified therein. If no time is specified, it ends at 11:59 PM (German time zone) on the day mentioned.
2.2.
The Organizer reserves the right to end the participation period prematurely or extend it appropriately for an important reason (e.g., technical malfunctions, legal reasons).
3. Eligibility
3.1.
Eligible to participate are natural persons who are at least 18 years old and reside in a country to which the Organizer regularly delivers. The current list of countries can be found at www.mycover-protection.com/versand__lieferung/. The status at the end of the entry period is authoritative.
3.2.
Employees of the Organizer, their relatives, and persons involved in the conception and implementation of the giveaway are excluded from participation.
3.3.
Participation is only permitted once per person, regardless of the number of user accounts and platforms used. If a giveaway is conducted simultaneously on several platforms, a person only counts once, even if they participate on multiple platforms. In the event of multiple entries or the use of multiple accounts, the Organizer reserves the right to disqualify the participant.
3.4.
Participation via automated services (bots, giveaway services, etc.) is not permitted and will lead to exclusion.
4. Participation in the giveaway
4.1.
Entry takes place exclusively within the entry period by fulfilling all entry requirements mentioned in the Giveaway Post. These may include, in particular: following the organizing account, liking the post, commenting on the post, or tagging other people in the comments.
4.2.
Participation is free of charge and is not linked to a purchase or any other paid service.
4.3.
The Organizer reserves the right to delete comments that violate applicable law, public decency, or the terms of use of the respective platform and to disqualify the participant.
4.4.
Tags may only refer to real people and only with their consent. Tagging in the image material itself is not a requirement for entry.
5. Prizes
5.1.
The type, number, and composition of the prizes, as well as the number of winners, are specified in the respective Giveaway Post. If a product is available in several sizes or variants, the selection will be made after consultation with the Organizer.
5.2.
Cash payment, exchange, or transfer of the prize to third parties is not possible.
5.3.
The Organizer reserves the right to provide an equivalent replacement prize in the event that a prize is unavailable.
5.4.
Any tax obligations in connection with the prize are the responsibility of the respective winner.
6. Determination of winners
6.1.
The winners will be determined by random draw from among all valid participants after the entry period has expired. For cross-platform giveaways, all entries will be considered in a joint draw.
6.2.
The draw will take place behind closed doors.
6.3.
The Organizer is entitled to announce the winners’ usernames on its social media channels. An objection is possible at any time by sending a message to the Organizer and does not lead to the loss of the prize.
7. Winner Notification and Prize Handover
7.1.
Winners will be notified within 5 working days after the draw via direct message on the platform where the giveaway was conducted.
7.2.
The winner must confirm their prize within 14 days of notification by providing feedback (including the data necessary for shipping).
7.3.
If no feedback or incomplete feedback is received within the deadline, the claim to the prize will be forfeited without replacement. The Organizer is entitled to determine a replacement winner.
8. Shipping of prizes
8.1.
Prizes will be shipped free of charge to the address provided by the winner.
8.2.
Shipping is only available to delivery addresses in countries to which the Organizer regularly delivers (see www.mycover-protection.com/versand__lieferung/). If a prize cannot be delivered for reasons for which the winner is responsible, the claim to the prize will be forfeited.
8.3.
The Organizer is not liable for delivery delays or loss during shipping, unless these are based on intent or gross negligence on the part of the Organizer.
8.4.
For deliveries to countries outside the European Union, customs duties, import duties, and taxes may apply. These shall be borne by the winner.
9. Exclusion from the giveaway
9.1.
The Organizer reserves the right to exclude participants from the giveaway if there is an important reason, in particular in the case of:
- Violations of these terms and conditions
- Attempts at manipulation or the use of unauthorized aids
- False or incomplete information
- Violations of applicable law or the rights of third parties
9.2.
In the event of a subsequent exclusion, a prize that has already been delivered can be reclaimed.
10. Premature termination or changes
10.1.
The Organizer reserves the right to change, suspend, or prematurely terminate the giveaway at any time for an important reason (e.g., technical malfunctions, legal reasons, force majeure), without this giving rise to any claims by the participants against the Organizer.
11. Liability
11.1.
The Organizer has unlimited liability for intent and gross negligence as well as for damages resulting from injury to life, body, or health.
11.2.
Otherwise, the liability of the Organizer is excluded to the extent permitted by law. This applies in particular to technical malfunctions, interruptions of the platform, or data loss.
11.3.
The above limitations of liability do not apply if mandatory legal regulations (in particular consumer protection regulations of the participant’s country of residence) stand in the way.
12. Data Protection
12.1.
The Organizer is responsible for the processing of personal data within the framework of the giveaway (see section 1.1 for contact details).
12.2.
The personal data collected as part of the giveaway (in particular the username on the respective platform and, if applicable, the winner’s name and delivery address) will be processed exclusively for the purpose of running and administering the giveaway. The legal basis is Art. 6(1)(b) GDPR (performance of a contract/pre-contractual measures) and Art. 6(1)(f) GDPR (legitimate interest in the proper conduct of the giveaway).
12.3.
The data will be deleted after the giveaway has been fully processed and any statutory retention periods have expired.
12.4.
Data will only be passed on to third parties if this is necessary for the implementation of the giveaway (e.g., to shipping service providers for the delivery of the prize).
12.5.
Participants have the right to information (Art. 15 GDPR), rectification (Art. 16 GDPR), erasure (Art. 17 GDPR), restriction of processing (Art. 18 GDPR), data portability (Art. 20 GDPR), and objection (Art. 21 GDPR). In addition, there is a right to lodge a complaint with a competent supervisory authority.

13. Final Provisions
13.1.
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection provisions of the state in which the participant has their habitual residence remain unaffected.
13.2.
Should individual provisions of these terms and conditions be or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected.
13.3.
No correspondence will be entered into regarding the giveaway.
13.4.
The Organizer is neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
